Texas Softball Hall of Fame 2009 Waiver
As manager or the manager's representative for the team indicated below, I assume the responsibility for advising each team member of the following information:1. The manager is responsible for players, fans, and spectators.
2. Public Parks do allow food or beverages, but no glass containers. No alcohol is allowed at Community Park in Mo. City, TX.
3. It is the managers responsibility to convey game times and field assignments to his team and to understand that rainout or postponed games may be rescheduled whenever necessary.
4. Managers assume liability for all players who fail to sign the Texas Softball Hall Of Fame 2009 roster and waiver form, yet still participate on his or her team.
5. A manager is required to communicate his or his teams needs in a timely and sportsmanlike manner. The office may be reached at 281-342-0789. A softball director will be on duty during games.
6. A manager should be aware that for any item not covered in the ASA Rulebook, Texas Softball Hall Of Fame retains the sole and exclusive right to rule and pass judgment as deemed necessary. This includes bats which are banned. It is the managers responsibility to notify his team of any and all banned bats. The list is published at www.txsoftballhalloffame.com. The current list will be reviewed and updated on a seasonal basis in 2009 and may be revised by the director at any time he deems necessary.
7. As the manager or manager's official representative, I wave, release, and indemnify Texas Softball Hall Of Fame, its owners, employees, leasing partners, officials, umpires, and Board of Directors, from my team's participation in any Texas Softball Hall Of Fame event. Furthermore, I waive and release all liability for injuries and/or death from any cause and from any bats or balls which are allowed in play for these recreational events, including those not allowed for Championship play. Also, I agree to only use alcohol responsibly and understand that any and all injuries, accidents, property damage, or deaths from my alcohol use are my sole and complete liability and not that of Texas Softball Hall Of Fame, its owners, employees, leasing partners, officials, Board of Directors, ASA, its agents, and umpires.
8. As part of the consideration for this service and the right to play softball, I hereby agree to protect, defend, indemnify, and save Texas Softball Hall Of Fame and any of its members, employees, officers, directors, committees, agents, contractors, umpires, and any of their successors, heirs, assigns, affiliated sister and parent companies, ASA, its agents and umpires, harmless from and against all claims, demands, and causes of action of any kind or character arising directly or indirectly out of in or in connection with softball activities, in favor of any person or entity including without limitation claims and/or causes of action for damage to or a loss of use of property or personal or bodily injury and/or death, caused by the sole, joint, comparative or contributory negligence, of Texas Softball Hall Of Fame, regardless of whether such negligence, is the sole, joint, comparative, or contributing cause of any claim, demand, cause of action, or liability indemnified against.
